On July 23, 2026, Penn-Florida's Mandarin Oriental Residences, Boca Raton, became the target of a $417.7 million foreclosure lawsuit. The development, already long-delayed, now faces claims of default from lenders tied to Apollo Global Management, as first reported by The Real Deal.

The lenders allege multiple breaches, including missed interest payments since June 2024, failure to repay the loan at its September maturity, and missing the February 2025 completion date. According to the South Florida Business Journal, the complaint also cites termination of the hotel's management agreement.

The suit names Via Mizner Lender 1 LLC as the plaintiff, representing a consortium that includes Athene Annuity and Life Company and Athora Lux Invest NL-CRE Direct Lending Fund. The complaint also encompasses contractors with construction liens and condominium buyers, some of whom have already sued the developer over project delays.

The total sum sought by the lending group includes the original $270 million principal balance, an additional $24.6 million advanced for project expenses, and other accrued interest and fees. Should foreclosure proceed, mortgage lenders typically take precedence over construction lienholders and most other creditors, leaving contractors and unit buyers in a precarious position. The Real Deal notes that one buyer previously secured a $1.98 million judgment against the developer, while another reached a $2.1 million settlement.
